In the case of a security or confidentiality breach, you must immediately notify Magnifying Class. This includes transferring or transmitting inside information, confidential or proprietary information acquired under nondisclosure agreements or through employment relations. In accordance with the terms of this agreement, you explicitly understand, accept, and concur that Magnifying Class is not liable for any direct, indirect, special, consequential, incidental, or exemplary damages, which includes but is not limited to: damages due to the loss of profits, data, use, goodwill or other intangible losses as a result of using the services or the inability to use the services; the cost to find substitute services and goods resulting from any services, goods, information or data bought or acquired, as well as messagesreceived or transactions carried out through or from the services; the alteration of or the unauthorized access to data, statements, or conduct of any Magnifying Class third party services; or any other issue connected to the services According to the terms of the agreement, you explicitly understand, accept, and concur that Magnifying Class shall not be responsible for any of the previously mentioned damages you may experience through using its services, even if Magnifying Class has been notified of the chance of such damages.
10. You understand, accept and agree, under these terms of use, that any software associated to the Magnifying Class services consists of custodial, copyrighted and confidential information that is protected by suitable intellectual property laws as well as other applicable laws. You explicitly recognize, accept and concur that the Content within sponsor advertisements or information presented to you through advertisers or the Magnifying Class services is protected by patents, copyrights, service marks, trademarks or other proprietary rights and laws. You also explicitly acknowledge, accept and agree not to alter, lease, loan, sell, disperse, or create similar content based off of the previously mentioned software or services unless otherwise authorized by the Magnifying Class services or associated advertisers. You also specifically understand it is strictly prohibited to carry out a mass download for the purpose of possible distribution, as the courses were designed for individual use and study. It is illegal to reproduce or distribute this copyrighted work without authorization. Criminal copyright violation, including violation without capital compensation, will be investigated by the FBI and those affiliated with the crime may be punished with harsh civil and criminal penalties. You acknowledge that by making any efforts to evade the educational process of the Magnifying Class services (such as circumvent assignments, quizzes, tests, etc.) in order to acquire access to Magnifying Class’s copyrighted Content for direct download is not the intended use of the educational service or content. Such efforts are not approved will result in the associated account(s) being suspended. In addition, you understand that Magnifying Class, LLC is an educational site; account limitations or suspension may result after excessive failure rates in course lessons.
11. Plagiarism is strictly prohibited for any of your content submissions to the Magnifying Class courses of study. This includes but is not limited to “copying and pasting” lesson materials as a response to an assignment or taking information from other websites, books, videos, etc. and copying it as your submission for an assignment or other course requirement. You concur that you must use your own words or otherwise clearly quote and properly cite any content or information you submit to the Magnifying Class course. If you do not comply with these requirements, you risk failing the course and/or having your account suspended without any refund. Use of data mining robots or other data extraction tools are not included in your rights to access the Magnifying Class Content and services. Access to our services also does not mean that you are permitted to metatag or mirror our website without first receiving our written permission.
12. All trademarks, brands and logos generally identified either with the symbols TM or ®, which are used on this website, are either owned by us or we have a license to use them. Your access to our website does not license you to use those marks in any commercial way without our prior written permission.

Abiding by the terms of this agreement, you concur to report any violations of the previously mentioned conditions to the Magnifying Class’ Customer Services Department. These conditions must be met in order for you to have complete usage of the Magnifying Class services. 17. Links to other sites and Resources. Links on the Site to third-party websites are provided solely as a convenience to you. We do not approve or endorse the content of hyperlinked third- party sites, and you agree that we will have no responsibility or liability in connection with your use of any linked third-party sites.
15. You may hyperlink our website without our consent. Any such hyperlinking will be entirely your responsibility and at your expense. By linking our website, you must not alter any of our website's contents including any intellectual property notices and you must not frame or reformat any of our pages, files, images, text or other materials.
16. Magnifying Class reserves the right to interrupt, reschedule or discontinue any course as well as alter its content and any evaluations methods at any time. Under the Magnifying Class’ discretion, your performance and evaluation in any course is determined. It is possible for you to earn a Certificate upon successfully completing a Magnifying Class course. Nevertheless, you understand that this Certificate does not possess any affiliation with any university or college institution. You understand that Magnifying Class certificate awarded to you will not substitute or replace any program or certificate course taken at an accredited institution. You also acknowledge that you will not receive any academic credit upon completion of a Magnifying Class course. It is prohibited to use any certificate or award issued by Magnifying Class to serve as any part of any for-credit certification or tuition-based program for any academic institution, including college and university institutions, amongst others. Using Magnifying Class Certificates in such form is a violation of these Terms of Service.
17. If you in any way “participate” in any Magnifying Class online course, which may include but is not limited to registering, enrolling or auditing a course, you concur that your enrollment length of time is limited. In accordance with the time limitation, you understand that if you fail to complete a Magnifying Class course within the allotted time frame permitted or declared by Magnifying class (generally 180 days unless otherwise stated), you agree to the following: 1. After your enrollment period has ended, there are no refunds or credit/vouchers for the course. 2. If you do not complete the course within or after the specified time frame, there are no refunds on any portion of the Course Fee or Pre-Paid Discount Certificate Option. In addition, there are no refunds, discounts, returns, extensions, credits, vouchers or exchanges on any used or unused parts of any membership or subscription plans associated with the Magnifying Class website.
18. Refund Policy. If you decide not to complete a course that you've paid for, Magnifying Class may be able to refund your payment depending on following policies: You can request a refund within the first week (7 days) after your payment. Contact the support department (support@magnifyingclass.com) with a satisfactory explanation about requesting a refund, including a detailed explanation of why the learner cannot continue the course. The course fee may be refunded to the customer usually in the method of payment originally given to Magnifying Class, provided that less than 20% of the course content hasbeen accessed by the learner. After 7 days from the payment, the course fees are non- refundable. And also once the learner has earned your Course Certificate, the customer is no longer eligible for a refund.
19. These Terms of Use, and any claim or dispute that arises from or relates to your use of the Site or the Content, will be governed by the laws of Florida (US), without regard to its Conflicts of Laws principles. You agree that all such claims and disputes will be heard and resolved exclusively in courts sitting in Florida. You consent to the personal jurisdiction of such courts over you for this purpose, and waive and agree not to assert any objection to such proceedings in such courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum). If you choose to access our website from locations other than Florida, you will be responsible for compliance with all local laws of those other locations.
20. As a user, you agree to indemnify and hold us harmless from any liability, claim, action, demand, loss, costs including legal costs on a full indemnity basis and expenses arising out of or in connection with any Content you provide.
